Terms of Service

These Terms govern your use of PercentileX (the "Service"), operated by Harrison Dane, an individual based in California, United States ("we", "us"). By using the Service you are entering into an agreement with Harrison Dane. By accessing or continuing to use the Service, you agree to these Terms.

1. The Service

PercentileX lets you enter personal stats (finance, fitness, education) and compare them to estimated population benchmarks, set goals, view progress history, and, on the Plus plan, receive AI-generated coaching and goal suggestions.

2. Eligibility and accounts

You must be at least 16 years old, and if you are under the age of majority you need permission from a parent or guardian. Provide accurate information, keep your login credentials confidential, and you are responsible for activity under your account.

3. Acceptable use

You must not misuse the Service, including by:

• using it for any unlawful purpose, fraud, or spam;
• infringing anyone's intellectual property or other rights;
• introducing malware, probing or testing vulnerabilities, scraping, or interfering with security or performance;
• reverse engineering, reselling, or circumventing plan limits or technical restrictions;
• attempting to make the AI features produce illegal, hateful, or harmful content, or to bypass their safeguards.

4. Not professional advice

Benchmarks, scores, salary forecasts, and AI outputs are estimates for general and educational purposes only. They may be inaccurate or incomplete and are not financial, investment, tax, legal, medical, or fitness advice. Consult a qualified professional before making decisions, and verify any AI output yourself. Your decisions are your own responsibility.

5. AI features

You are responsible for what you enter and how you use outputs. We may filter, refuse, or remove outputs, and restrict accounts that abuse AI features.

6. Intellectual property

Harrison Dane retains all rights in the Service, including its software, design, documentation, and the PercentileX name and branding. We grant you a limited, non-exclusive, non-transferable licence to use the Service within your plan. You keep ownership of the data you enter and grant us a limited licence to store and process it solely to provide the Service.

7. Plans, payments, and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Plus subscriptions renew automatically each billing period (monthly or yearly) until cancelled. Payment, billing, taxes, cancellation, and refunds are governed by Paddle's Buyer Terms and our Refund Policy.

8. Service availability

We work to keep the Service running, but we do not guarantee it will be uninterrupted, timely, or error-free. We may change or discontinue features.

9. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations. You may stop using the Service and request account deletion at any time. After termination we delete or anonymise your data within a reasonable period unless the law requires us to keep it.

10. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages such as lost profits or data. Our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability for fraud, death, or personal injury where the law does not allow it.

11. Indemnity

You agree to indemnify us against claims arising from your content, unlawful use, or breach of these Terms.

12. General

These Terms are governed by the laws of the State of California, United States, and disputes will be resolved in the state or federal courts located in California. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or sale. We are not responsible for delays caused by events beyond our reasonable control. We may update these Terms and will post the new date above.
